Biography
Focco Lunsingh Scheurleer assists clients on a broad spectrum of matters in Banking & Finance and Company Law. He is responsible for assisting clients in numerous loan and credit facilities to local borrowers (utility, telecom and hospitality) as well as international borrowers with group members in the Netherlands Antilles and Aruba, either structured as syndicated loan facilities or as capital market transactions (bond issues). Focco advises financial institutions as well as associations of financial market parties on regulatory matters, netting and close-out as well as securities lending. Furthermore, he assists parties in preparing collateral documentation to secure investment institutions’ borrowing obligations to their lenders. His activities in Company Law may encompass advising clients on the acquisition or divestiture of businesses in our jurisdictions as well as corporate law issues, including corporate restructuring.

Focco started as an attorney in 1995 at Trenité Van Doorne in Rotterdam, currently Simmons & Simmons. In 2000 he was transferred to VanEps Kunneman VanDoorne. He has been active as a board member of the Curacao International Financial Services Association, was a part-time lecturer International Private Law at the University of the Netherlands Antilles and has been involved in a number of legislation projects.

• AIB Bank syndicate in the financing of the Ritz-Carlton Aruba Hotel
• Banks and borrowers in various international financing transactions
• Columbus Networks in the acquisition of a local legal entity, including the license for a television broadcasting station pursuant to which offering of internet, telephone and television will be possible
• Credit Suisse in the financing of various Dutch Caribbean hotel acquisitions
• Delta Lloyd, the Dutch insurance company, on its sale of a mortgage portfolio to Arubabank
• RBTT Bank in the refinancing of the Aruban Divi Hotel Group
• Scotia Bank in the financing of the new Curacao Hyatt hotel project
• The purchaser in the USD 237 million acquisition of the Marriott Hotel on Aruba
