Award of 10th VanEps Kunneman VanDoorne thesis prize
Each year, law firm VanEps Kunneman VanDoorne awards a prize to the best written master thesis for law studies at the University of the Netherlands Antilles. VanEps Kunneman VanDoorne selects the winning thesis from all theses graded with an 8 or higher by the teachers.
This year, Mr. Alan Henriquez was the winner of the 10th VanEps Kunneman VanDoorne thesis prize.
The title of Henriquez’ thesis is “Pensioendeling bij echtscheiding op de Nederlandse Antillen: verrekenen, verevenen of iets anders?” (Division of pension in case of divorce in the Netherlands Antilles: setoff, equalize, or something else?). In his thesis Henriquez compares the setoff of the pension in case of divorce in the Netherlands and in the Antilles. In the Netherlands the Equalization of Pension Rights in the Event of a Divorce Act has been effective since 1995, whereas in the Antilles the setoff system is still based on the “Boon en Loon” ruling of the Supreme Court. In short, Henriquez comes to the conclusion that introduction of the legal system did not have the intended effect in the Netherlands and consequently orders a different, very clearly contrived, statutory regulation for the Antilles.
