Aqualectra adviser is bankrupt
Willemstad – Jacobus Jacobs, financial adviser of Aqualectra, has been declared bankrupt on 30 September. This follows from a judgment of the Court of First Instance Curaçao passed on that date.
In an advertisement in this newspaper yesterday, Jacobs is called to meet the trustee, Nanne B. Holtrop, at the offices of VanEps Kunneman VanDoorne in order to unwind his personal bankruptcy. He can voluntarily report up to and including Friday, 11 November 2011. The bankruptcy was filed by a person from Belgium, but the “Antilliaans Dagblad” learned by a statement from some other person that four declarations were filed against him in the Netherlands.
Several other complaints were filed with the Dutch Association of Register Controllers in Amsterdam. “It really surprises me that Mr. Jacobs was given the opportunity to be engaged in the finances of several companies”, one of those who filed a report informs this newspaper. The hearing of the legal proceedings was adjourned, the judgment states, because Jacobs did not live at the indicated address in Curaçao. “The attorney then referred to a newspaper notice showing that defendant (Jacobs, ed.) was recently employed by the Supervisory Board (“RvC”) of Aqualectra as financial adviser and also provided his mobile phone number.”
After Jacobs had been called, the judgment states, he told the Clerk of the Court that he did not want to hear about the case, that he would not appear, and that the Clerk should send all documents to his Miami address, which he refrained to provide. Jacobs had himself deregistered from the population register in Rotterdam in April 2011 to depart for Curaçao. “In Curaçao he did not register, but it sufficiently appears from the fact that he has a mobile phone here that he also answers, and has himself employed as financial adviser of Aqualectra, that he actually resides here and practices a profession or has a residence in this country”, according to the judge, who continues: “It appears that the financial adviser fails to pay several debts.”
From an internet search it appears that Jacobs was involved in the bankruptcy of two companies, notably Het Betaelhuys BV and Penninck & Landheer BV. The bankruptcy for Penninck & Landheer was filed by the Tax Receiver Rijnmond.
“At the time of the bankruptcy, the only possible employee was Mr. Jacobs. He told the trustee that he had already resigned before the bankruptcy”, the bankruptcy report, prepared by Van den Herik & Verhulst, says, which report also states: “The total of the unsecured debts filed is 540,076.43 euro. It is reported that these two companies are subject of an investigation by the Fiscal Intelligence and Investigation Service (“FIOD”).
An extract of the Chamber of Commerce in the Netherlands shows that Jacobs used to be director of the meanwhile closed Faucqmont. In Curaçao he owns Sybe Financial Services NV, as an extract of 20 October 2011 shows. Sybe was established on 8 September 2003.
