Since 2013, VanEps Kunneman VanDoorne has been actively involved in the implementation of the Electricity and Drinking Water Act BES. In August 2013, a reaction was submitted during the consultation phase. Tom Peeters, lawyer and manager of VanEps Kunneman VanDoorne firm in Bonaire, identified several bottlenecks regarding the implementation of the new rules on the BES islands. The legislator applied most suggestions for improvement, and on 22 April 2016, the Act was adopted and published in the Bulletin of Acts and Decrees. The law is expected to come into effect on 1 July 2016.

With attorneys Lorena Navia and Carlos Winkel taking the oath on Tuesday 7 June 2016, both the Bonaire office as well as the Curaçao office of VanEps Kunneman VanDoorne have added a sworn attorney to their teams. Lorena started at VanEps Kunneman VanDoorne in Bonaire in January and Carlos joined the Curaçao office in March. Both attorneys start in the firm’s Litigation & Commercial section.

The court has ruled on Monday 13 June 2016 in its final judgment, that Isla is indeed responsible for the oil spill in the Jan Kok nature reserve. The court already ruled that this was currently proven in July 2014, which resulted in Isla needing to prove that there was another tangible cause in order to avoid responsibility for the damage. Attorney Rogier van den Heuvel of VanEps Kunneman VanDoorne represented the plaintiffs and owners of the polluted area (the Foundation for the Preservation of Historic Buildings and Sites, and Sea Shore Properties NV) in these legal proceedings, that were initiated in 2012 already.

The Aruban Ministry of Public Health, Elderly Care and Sports and VanEps Kunneman VanDoorne recently organized a two-day seminar ‘Good Governance in Health Care and Sports in Aruba’. This seminar was inspired by the newly launched and well received ‘Dia di Fundashon’ in Curaçao, that was attended by 200 people this March. During the seminar on Aruba, directors of foundations and associations in the field of health care and sports were given the opportunity to engage with various corporate governance experts. In one morning, the participants could attend four workshops, of which one plenary. This unique concept turned out to be a gap in the market in Aruba as well.

On 12 April 2016, The Ministry of Tourism of Aruba has submitted a legislative bill to Parliament, introducing a new licensing system for hotels that offer all-inclusive accommodation. This bill was publicly announced in a press conference on Monday 9 May 2016. Lawyers Frank Kunneman, Tom Peeters, and Sophie van Lint of VanEps Kunneman VanDoorne advise the ministry regarding the establishment of the legislation.

In 2007, partner Molly Steward of VanEps Kunneman VanDoorne launched a first book with the collected employment laws and regulations of the Dutch Antilles. The constitutional changes and the dissolvement of the Dutch Antilles in 2010, created the need for a sequel that collects the employment legislations of the country of Curaçao.

On 12 May, the Kingdom Council of Ministers decided to reject the appeal against the extension of financial supervision, filed by the Curaçao Government. This decision was made based on the advice of the Kingdom Council of State and was identical to the draft decision (‘concept besluit’) that the Council of State had prepared.

The guide gives a summary of the current laws and regulations in Curaçao for retail funds and hedge funds. The Curaçao section was already compiled by the team of VanEps Kunneman VanDoorne in 2015, but has been updated for the new volume.

Stefan Sagel addressed lawyers and clients on four islands – Aruba, Bonaire, Curaçao, and St. Maarten – simultaneously.
