After successful workshops on Bonaire and on Aruba during the P3A Conference in March 2016, VanEps Kunneman VanDoorne has organized a lunch seminar Procurement and Contracting on Curaçao as well on 7 July. The unexpectedly large number of registrations for the seminar resulted in a shortage of space in the venue, and demonstrated that transparency in procurement procedures is a hot topic on Curaçao as well.

This month, Molly Steward, partner with VanEps Kunneman VanDoorne, launches the ‘Collected Employment Laws and Regulations Curaçao 2015’, which she compiled. For this purpose, she presented the first copies of the book this week to Ms. Ruthmilda Larmonie-Cecilia, Minister of Social Development, Employment & Welfare, and to Mr. Evert-Jan van der Poel, President of the Joint Court of Justice, together with counsel Kimberley de l’Isle.

CIBC FirstCaribbean and NuCapital together with Aspiravi have reached on 1 July 2016 an agreement on the financing of five new windmills, to be built at the existing wind farm at Tera Kòrá in Curaçao. The total investment is USD 36mln. VanEps Kunneman VanDoorne assisted parties in this transaction. Team members for the finance part of the transaction were partner Focco Lunsingh Scheurleer, counsel Natasha Joubert, and associate Shalini Sadal and Vincent Abbing.

Real Estate lawyer Tom Peeters has been appointed partner with VanEps Kunneman VanDoorne as per 1 July. Tom joined the Dutch Caribbean firm in 2013 and heads the Bonaire office. Under his wing, the branch has steadily grown and managed to achieve a permanent position as market leader on the island, with clients such as the (Central) Government, utility companies, the airport, and various international hotels.

The sixteenth VanEps Kunneman VanDoorne Thesis Prize was awarded to Leanne Mous. The prize – a check and a certificate – was presented to her by attorneys Carlos Winkel and Aubrich Bakhuis. With this annual prize, VanEps Kunneman VanDoorne awards the author of the best master thesis at the Faculty of Law of the University of Curaçao.

Since 2013, VanEps Kunneman VanDoorne has been actively involved in the implementation of the Electricity and Drinking Water Act BES. In August 2013, a reaction was submitted during the consultation phase. Tom Peeters, lawyer and manager of VanEps Kunneman VanDoorne firm in Bonaire, identified several bottlenecks regarding the implementation of the new rules on the BES islands. The legislator applied most suggestions for improvement, and on 22 April 2016, the Act was adopted and published in the Bulletin of Acts and Decrees. The law is expected to come into effect on 1 July 2016.

With attorneys Lorena Navia and Carlos Winkel taking the oath on Tuesday 7 June 2016, both the Bonaire office as well as the Curaçao office of VanEps Kunneman VanDoorne have added a sworn attorney to their teams. Lorena started at VanEps Kunneman VanDoorne in Bonaire in January and Carlos joined the Curaçao office in March. Both attorneys start in the firm’s Litigation & Commercial section.

The court has ruled on Monday 13 June 2016 in its final judgment, that Isla is indeed responsible for the oil spill in the Jan Kok nature reserve. The court already ruled that this was currently proven in July 2014, which resulted in Isla needing to prove that there was another tangible cause in order to avoid responsibility for the damage. Attorney Rogier van den Heuvel of VanEps Kunneman VanDoorne represented the plaintiffs and owners of the polluted area (the Foundation for the Preservation of Historic Buildings and Sites, and Sea Shore Properties NV) in these legal proceedings, that were initiated in 2012 already.

The Aruban Ministry of Public Health, Elderly Care and Sports and VanEps Kunneman VanDoorne recently organized a two-day seminar ‘Good Governance in Health Care and Sports in Aruba’. This seminar was inspired by the newly launched and well received ‘Dia di Fundashon’ in Curaçao, that was attended by 200 people this March. During the seminar on Aruba, directors of foundations and associations in the field of health care and sports were given the opportunity to engage with various corporate governance experts. In one morning, the participants could attend four workshops, of which one plenary. This unique concept turned out to be a gap in the market in Aruba as well.
