On Tuesday 23 August 2016, the legislative bill introducing a new licensing system for all-inclusive accommodation in Aruba was adopted by the Parliament. The proposed amendments to the Licensing Ordinance were approved with twelve votes in favor and eight against. Attorneys at law Frank Kunneman, Tom Peeters, and Sophie van Lint of VanEps Kunneman VanDoorne advised The Ministry of Tourism on the drafting of this new legislation.

Recently, the fourth edition of the German Handbook Distribution Law (Handbuch des Vertriebsrechts) has been published. With its 2329 pages, this book gives an extensive explanation of the distribution law in and outside of Germany. Attorney at law Roderik van Hees contributed with a chapter on distribution law, agency law and franchise law in the Netherlands. The handbook has been published by publishing company C.H. Beck and is available via their website.

On August 4, law firm VanEps Kunneman VanDoorne organized a seminar for its clients about structured finance; the collective term for special ways to finance companies. This means that a company is not financed by an ordinary loan, but by instruments such as securitization, covered bonds and factoring. Based on recent practical examples, the 60 participants were updated on assets (for instance loan portfolios and lease portfolios) and how to secure them for financiers.

Wolf Legal Publishers recently published the collection The relationships in the Kingdom of the Netherlands, a future perspective (‘De verhoudingen in het Koninkrijk der Nederlanden, een perspectief op de toekomst’) . This publication gives an overview of the plenary presentations that were given during the annual Conference of Constitutional Law in 2015 in the Netherlands. In addition, the book provides a number of selected papers of experts in the field of the new relations in the Kingdom since 10 October 2010. One of these authors and experts is Aubrich Bakhuis; attorney at law at VanEps Kunneman VanDoorne.

On Tuesday 26 July 2016, junior associate Seyed Navid Zahedi was sworn in by the Joint Court of Justice of Curaçao, Aruba and St. Maarten and of Bonaire, St. Eustatius, and Saba. Seyed Navid started at the Curaçao office of VanEps Kunneman VanDoorne on 1 April 2016. The team in St. Maarten has also expanded; associate Stan van Liere joined the firm on 1 June 2016.

After successful workshops on Bonaire and on Aruba during the P3A Conference in March 2016, VanEps Kunneman VanDoorne has organized a lunch seminar Procurement and Contracting on Curaçao as well on 7 July. The unexpectedly large number of registrations for the seminar resulted in a shortage of space in the venue, and demonstrated that transparency in procurement procedures is a hot topic on Curaçao as well.

This month, Molly Steward, partner with VanEps Kunneman VanDoorne, launches the ‘Collected Employment Laws and Regulations Curaçao 2015’, which she compiled. For this purpose, she presented the first copies of the book this week to Ms. Ruthmilda Larmonie-Cecilia, Minister of Social Development, Employment & Welfare, and to Mr. Evert-Jan van der Poel, President of the Joint Court of Justice, together with counsel Kimberley de l’Isle.

CIBC FirstCaribbean and NuCapital together with Aspiravi have reached on 1 July 2016 an agreement on the financing of five new windmills, to be built at the existing wind farm at Tera Kòrá in Curaçao. The total investment is USD 36mln. VanEps Kunneman VanDoorne assisted parties in this transaction. Team members for the finance part of the transaction were partner Focco Lunsingh Scheurleer, counsel Natasha Joubert, and associate Shalini Sadal and Vincent Abbing.

Real Estate lawyer Tom Peeters has been appointed partner with VanEps Kunneman VanDoorne as per 1 July. Tom joined the Dutch Caribbean firm in 2013 and heads the Bonaire office. Under his wing, the branch has steadily grown and managed to achieve a permanent position as market leader on the island, with clients such as the (Central) Government, utility companies, the airport, and various international hotels.
