The country of St. Maarten and the Benelux Office for Intellectual Property (BOIP) have signed an agreement for the execution of trademark legislation in St. Maarten. As per 1 January 2015, BBIE will introduce a new procedure for trademark registration with validity in St. Maarten. This will facilitate online submission of trademarks, which will result in a faster completion of the registration procedure. The trademark register itself will be accessible online. Miriam den Boogert, IP attorney at VanEps Kunneman VanDoorne: “This agreement means a huge step forward in the efficiency of trademark registrations. Our experience with BBIE regarding trademark registrations on Bonaire, St. Eustatius and Saba is excellent. On behalf of VanEps Kunneman VanDoorne, Tom Peeters and Sophie van Lint have responded to information from the Public Body of Bonaire regarding long lease, and adjustment and enforced collection thereof. A news article in Antilliaans Dagblad (Antillian Daily) suggested that the Bonaire local government is entitled to adjustment and enforced collection if the long lease isn’t paid in time. VanEps Kunneman VanDoorne is of the opinion that this information is incorrect. A response, explaining this view, has been published in local newspapers Antilliaans Dagblad (in Dutch) and Extra (in Papiamentu).

Law firm VanEps Kunneman VanDoorne launches a specialized team in Governance, Risk & Compliance. The firm engages drs. ing. Robbert Kroon (The Galan Group) as Counsel for this purpose. Together with prof. dr. Frank Kunneman, Kroon will be the face of the new practice group. Kunneman and Kroon have advised, published and lectured on corporate governance, risk, and compliance for years.

During a general meeting on Wednesday 19 February, Mark Kater has been reappointed as board member of the Bonaire Business & Employers Association (BBE). BBE represents all employers and the general business community of Bonaire, and is a negotiating partner of local and national governments. Mark is an attorney at law and Director of Client Relations and Marketing at VanEps Kunneman VanDoorne and already was a board member of BBE.

The Top 25 of law firms in Curacao, which is published annually by legal website Dutch Caribbean Legal Portal, shows that VanEps Kunneman VanDoorne is the largest law firm again this year. VanEps Kunneman VanDoorne grew to 24 lawyer in Curacao and 37 in total in the Dutch Caribbean.

Bonaire Holding Maatschappij (BHM) and its subsidiaries are starting a project to determine to what extent these organizations comply with the Code Corporate Governance Bonaire. With this project, they will determine if – and if so, which – improvements  need to be implemented. For guidance and advice in the project, BHM instructed The Galan Group and VanEps Kunneman VanDoorne.

Curoil Aruba has realized its first inshore bunkering in January 2014. In the port of Oranjestad, the cruise ship Monarch was supplied with fuel via the tanker Zeta-1. VanEps Kunneman VanDoorne advised Curoil in the last quarter of 2013 regarding the legal aspects of enabling the bunkering activities in Aruba.

As a result of the division documentation that was signed on Friday 13 December, St. Maarten will become GEBE’s sole shareholder as per 1 January 2014. In addition, Saba and St. Eustatius have incorporated new utility companies, Saba Electric Company N.V. and Statia Utility Company N.V. respectively, which will independently operate as of that date. The signing ceremony took place at the Sonesta Great Bay Beach Resort.
