Litigation

Litigation is traditionally a substantial part of VanEps Kunneman VanDoorne’s law practice. We litigate on all the islands of the Netherlands Antilles and Aruba where we mainly concentrate on cases in the Commercial and Company Law Practice. Due to the exceptional international orientation of the Netherlands Antilles and Aruba, many cases also have international aspects which are reflected in complex corporate relationships. At VanEps Kunneman VanDoorne we experience this as an exciting challenge and offer our clientele extensive experience in this field.

This practice also includes conducting proceedings in a myriad of administrative procedures which have greatly increased since the recent introduction of the National Ordinance on Administrative Proceedings.

An interesting aspect of litigation in the Netherlands Antilles and Aruba is that it contributes (modestly) to the development of law in the kingdom. This is due to the fact that the Supreme Court of the Netherlands in the Hague is also the highest court of justice on the islands.

• Successfully representing Curaçao Airport Partners as defendant in legal proceedings against various Airlines in relation to the costs of the new airport (2007).
• Successfully representing state owned Utility company against Island Government of Curaçao in relation to tariffs of electricity and water.
• Representing Aruba in dispute with the Kingdom of the Netherlands on the allocation of proceeds of the Marriott Aruba Hotel sale (2007).
• Successfully intervening as trustee of bankrupt estate of Casa Grande N.V. in Aruba legal proceedings (2007) .
• Successful representing Netherlands Antilles Bank Holding Co. in shareholders litigation (2007).
• Successfully representing Island Government of Curaçao as defendant in proceedings initiated by employees of state owned garbage company Selikor.
• Successfully representing former directors of bankrupt national airline DCA in personal liability suit brought by U.S. creditor (2007).
• Successfully representing K-Swiss in trademark infringement proceedings in Curaçao, Netherlands Antilles (2006).
• Successfully representing Adidas in major counterfeit dispute in Curaçao (2006).
• Successfully representing Mexican shareholders in various legal proceedings with alleged beneficial shareholder in Netherlands Antilles investment company (2006).
• Successfully representing the Netherlands Antilles Government in Sint Maarten casino license litigation (2006).
• Representing the Netherlands Antilles Government in a large number of disputes with civil servants.
• Representing various Netherlands Antilles and Aruba based banks in litigation relating to customer care and liability.
• Representing various Netherlands Antilles and Aruba based Insurance companies in a myriad of insurance related litigation.
